Mononomori Terms of Use

These Terms of Use (hereinafter referred to as the “Terms”) are established by WindMori Lab (hereinafter referred to as “we,” “us,” or “our”) and set forth the terms and conditions for the use of the iOS application “Mononomori” (hereinafter referred to as the “App”) and related services (collectively referred to as the “Services”). Users (hereinafter referred to as “Users”) are required to read and agree to the full text of these Terms before using the Services.

1. Definitions

1. Services: Refers to the App and all functions provided by us to Users.
2. Free Services: Refers to the features available free of charge, with limitations on the number of registered items and created spaces.
3. Pro Services: Refers to additional paid features available upon payment of the specified fee, including unlimited item and space registration, iCloud synchronization, and data management functions.
4. User Content: Refers to text, images, and other data entered, saved, or uploaded by Users through the App.

2. Agreement to the Terms

1. By using the Services, Users are deemed to have validly and irrevocably agreed to these Terms.
2. The Privacy Policy separately established by us shall constitute a part of these Terms.

3. Contents of the Services

1. Free Services: Users may use the basic features of the App free of charge, subject to limits on the number of registered items and spaces.
2. Pro Services: Users may remove these limitations and access additional features, including iCloud synchronization, by paying the specified fee (via subscription or one-time purchase).

4. Paid Services - Pro Services

1. Fees and Payment Methods: Purchases, refunds, price changes, and payment processing for Pro Services are governed by Apple Inc.’s App Store terms, and we bear no direct responsibility for these processes.

2. Provision Forms: Pro Services are offered either through auto-renewable monthly or yearly subscriptions or through one-time purchases for perpetual use.

3. Auto-Renewal Subscriptions:

   • Subscriptions automatically renew and incur charges unless canceled at least 24 hours before the end of the current period.
   • Cancellations must be made via the User’s Apple ID account settings in the iOS “Settings” app and cannot be made within the App.
   • Renewal fees and dates are notified in advance according to Apple’s regulations.

4. Restrictions After Cancellation: Users retain access to Pro Services until the end of the paid period. After expiration, if User Content exceeds Free Service limits:

   • Content will not be automatically deleted.
   • Adding new items, creating new spaces, or editing will be disabled (viewing and deletion remain available).
   • iCloud synchronization will be stopped.
   • Restrictions are lifted once the User deletes excess content or resubscribes to Pro Services.

5. One-Time Purchase Version: Users gain the right to use the Pro features available at the time of purchase for as long as the Services continue, but future features (e.g., AI features) are not guaranteed to be included free of charge.

6. Refunds upon Service Termination: Refunds for unused subscription periods upon service termination are handled according to Apple Inc.’s policies.

7. Price Changes: Pro Services price changes follow Apple Inc.’s regulations and are notified through the App Store.

5. User Content

1. Copyright of User Content belongs to the User who created it.
2. We do not store or collect User Content on our servers, nor do we have access to it. Content is stored only on the User’s device and Apple’s iCloud services.
3. Users warrant that their content does not infringe the rights of third parties.

6. Prohibited Acts

Users must not engage in the following acts when using the Services:

1. Acts violating laws or public order and morals.
2. Reverse engineering, decompilation, disassembly, or similar acts.
3. Infringing intellectual property, privacy, or other rights of us or third parties.
4. Acts that may interfere with the operation of the Services.
5. Any other acts deemed inappropriate by us.

7. Intellectual Property Rights

Except for User Content, all intellectual property rights related to the App and the Services belong to us.

8. Disclaimer

1. We do not guarantee that the Services meet specific purposes, expectations, functionality, accuracy, usefulness, or that they are free from defects.
2. We bear no liability for any damages arising from the use of the Services.
3. Users are responsible for backing up User Content, and we are not liable for loss or damage.
4. We are not responsible for damages caused by natural disasters, communication failures, or malfunctions of external services such as iCloud.

9. Changes to the Terms

We may amend these Terms as necessary. The revised Terms shall take effect when published on our website.

10. Termination of Services

We may terminate the Services and will endeavor to notify Users in advance.

11. Governing Law and Jurisdiction

1. These Terms shall be governed by the laws of Japan.
2. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any disputes arising hereunder.
